They got me... a little

    The story is:

    This is a Y intersection, just out of frame on the left is some construction. I was following driver left through the intersection when he evidently saw the construction and deciding to go right instead. He stopped and then backed up without seeing me. I grabbed a handful of horn when I realized what was happening, and his brake lights came on just as he hit me, but it was still hard enough to toss me off and shove the bike over. Damage is pretty minimal, crushed front fender, bent clutch and gear shift levers, more scuffs on the fairings and various other exposed bits than before of course. There was a small puddle of coolant on the ground under the bike, but I'm confident that was splash from the overflow reservoir. Driver was a nice guy, made sure I wasn't hurt, adamant that he'd pay for everything, offered to call the police several times, helped me lift the bike up, etc.

    My advice. Report it to your insurance company. Let them work out the details with the other guy. If things go south later on, they are the ones who go to bat for you against this guy. He ma be nice now but when the bills for the repair come in, he may change his tune and you will be fighting a battle with this guy to get paid.

    That is what you pay all that money to these huge thiev'n basterds of insurance companies for. Get the service you pay for and make them do their work.

    I also think that should have been reported to police. It could have been a child pedestrian your driver backed over without even looking to see what was there. What he did was really no different that driving forward down the road with his eyes close. Police may choose to do nothing about it but he would learn a lesson really quick and likely not repeat his failure to exercise due care and attention when backing up in the future.

    Yeah, I'd report it right away. Did you get his driver's license and insurance info? Clearly he's at fault. Since I used to sell insurance, for the sake of a claim, I truly hope you got the above info, else you may be fixing your bike yourself.
    Check your cooling system. Trust me, you don't want that going bad on you. Antifreeze will put you down in an instant if it gets on your back tire. I know this because it happened to me. Never assume yourself into a crash.

    Sorry about your accident - glad you didn't get hurt. This seems to be happening a lot lately where somebody stops suddenly in front of you and then starts backing up - without a reverse gear we're kind of sitting ducks if there's no room to get around them.     In hindsight do you think there's anything you could have done to avoid this other than having a much bigger following distance? Do you think an LED flasher like the one I use might have made the car driver more aware of your presence behind him or was he totally clueless? I notice his windows seem to be tinted VERY dark so I'm thinking an LED flasher might have helped.

    I see deep tinted windows. That would have been considered a huge contributing factor in a civil suit if it ever came to that.

    Aggh - nothing much you could have done to prevent that. At least you are fine.

    Randy is right - tell your insurers and let them get the bike fixed.

    As for alerting the police - I don't know what laws apply where you live, but in Europe if its a no injury incident then the drivers simply need to exchange driver and insurance details, but police must be called if anyone sustains any sort of injury and is strongly advised if there is any dispute over who is at fault. Hence it is good to see you got some clear photos - which should minimise the risk of your repair claim being contested. The scary thing is that even a slow speed tip over can run up a big bill when it comes to repairing motorbikes!

    Not sure I would inform the insurance companies, as long as u have the guys info and he plans on paying. If the insurance companies get involved, no matter who ends up paying, it is reported to companies like carfax and it does go on ur record as an accident. Insurance companies are sneaky that way. Ask me how I know this.

    Accident (or the now politically correct term, Crashes) reporting is a provincial mandate mater here in Canada. At the time I retired from policing, it was a requirement in law to report any accident, injury or not, involving a pedestrian, bicycle or motorcycle. That may have changed now. It was a lifetime ago that I retired from that and laws do change.

    Part of my reasoning here is that this driver may be on the verge of being called in for re-examination. I don't think his age was revealed in OP but as we age, our capabilities to safely operate a motor vehicle most often deteriorates. If you saw what I saw, your would be scared when you see what many seniors are doing behind the wheel of a car. There comes a time most of us need to hang up the keys and take transit or taxi. By this stage of the game, the amount we need transportation really does subside. The notion of "loss of independence" due to loosing driving privileges at this stage in one's life does not hold any water for the vast majority of cases. What can be more independent that to take a taxi somewhere, not worry about the capital cost of the vehicle, not to worry about gas prices or vehicle maintenance, parking, insurance. The list goes on.

    Both my parents voluntarily gave up driving. One day, I am likely to do the same. I hope that my wife would make the call to have me re-examined should she recognize the need when in the future. I have let her know that this is my wishes now that I am still able to reasonably make such a request.

    I just better make sure I don't piss her off though!

    The first thing the insurance company ask for in the UK when you tell them about this is the police incident number, if you can't provide one they aren't interested

    How can you be married and not piss off your wife? It's impossible, they start can't pissed off at you for not cutting the cake properly and it escalates from there.

    I mean, I'm sure I could've followed further away, stopped sooner, maybe positioned myself nearer to a mirror... but he also stopped 2/3rds of the way through an intersection, which is pretty odd and unexpected, and then he backed up... I was trying to back the bike out of his way once the backup lights came on... but as most of you know, these bikes aren't fast with pedal power.

    As far as I know, police are only required in the case of injury or in excess of $2000 worth of damage.

    As far as repairs and compensation, I've already ordered the parts, and I already have a cheque in hand from the driver. Not sure if the front fender is available yet, but everything else should be here tomorrow.

    Edit: Oh, and the parts list is Clutch lever, shift lever and rubber, left footpeg bracket, front fender. Total of about $570 CAD with tax.
