The 06 may be going back to the dealership...

    Its been 50 days since I purchased my VFR.
    A week after I bought it, I found out the dealership I bought it from is going out of business.
    I still don't have plates.
    My credit union still doesn't have my title.

    After 6 very irritating phone calls to the dealership (with responses like...try back tomorrow...I'll have the manager call you back ASAP...shit like that) I was very tired of being blown off, so I drove in there today to see WTF is going on.

    Finally get some sort of answer. They DO NOT have my title! They never did!
    Supposedly someone from Money train (pay day loan place) has my title...
    the manager tells me "here call these guys and ask them to release the title." writes some names and phone numbers on a piece of paper and basically says 'see ya later, good luck'

    I ask for a new temp so I can keep riding the bike..."we can't give you another temp without the old paper work being here"

    Fucking great...now I get to drive 12 miles home, get the bike, drive 12 miles back and get new temps for it. Thanks for wasting my time.
    on the way home, I called the pay day loan guy and he tells me "the edge hasn't paid off that bike yet"
    -me-"they told me they paid it off weeks ago"
    "nope, they still owe on it"
    -"thanks...."

    Drive back down. get new temps, tell them what the pay day loan guy said, they tell me "we definitely paid that off, we'll get it squared away."

    So I can hang on to the bike and keep hounding them to get it registered and get my title to where it belongs or I can return the bike and demand a full refund. (state law says if you don't have a plate within 45 days, you can do this)

    I really like the bike, but at the same time, I could probably just get my money back and go buy a newer ABS model (maybe get an 07 RWB???) for a little more money.
    The down sides are,
    I've just put a new rear tire and rear brake pads on
    I've installed frame sliders and different bar ends
    I've installed an LED license plate lamp
    I've already purchased a new tank to replace the dinged up one that came with the bike.

    As far as I know, it is illegal to sell something if you don't have the title.
    I'm thinking about going and talking to a lawyer. maybe I can come out of this with some money in pocket and keep the bike :biggrin: That might make up for all of this wasted time and the giant pain in my ass this place has been...douche bags.

    That is one fked up situation.No wonder that dealership is shutting down-incompetency!!

    After investing good chunk of money on newer parts it seems counter intuitive to return the bike.

    What I'd really like to know is, WTF is a PDL doing with the title to a bike for sale at the dealership?! Given that most PDLs insist on holding the bike also, something about this smells big time.

    Keep the bike, hire a lawyer, feed him/her some raw meat then hand over the addresses of the dealership and PDL...

    Called one yesterday... He handled a case for me a few years back so I figured I'd go with some advice from someone I sort of know.
    He wasn't in the office so I left him a message. Hopefully I hear back from him tomorrow (er...later today...damn graveyard shift screwing up my days)

    We'll see what he has to say on the matter.:thumbsup:

    You don't even need t a lawyer. File a case in small claims against the dealer and a complaint at the motor vehicles dept. I don't know where you are, but in most states that dealer is going to lose his license for selling an unsecured titleless vehicle.

    Some states (ohio) has a fund for vehicles without titles that are bought thru a dealership. Check with your states DMV.

    Yeah, his business may be kaput, but his license isn't. He'll be at auctions soon enough looking for POS cars to scam people on.

    this sounds like a very bad situation for you. i would be really pressing this dealer to refund and cut my losses on the stuff done. ( I BET YOU HE CANT CAUSE HE'S GOT NO FREAKIN $$$$!)

    the worst case scenario here is that the dealer goes bust and the loan company reposses your bike.:eek:

    you dont want to get caught in the middle of that situation

    good luck with this,i hope these guys come to there senses and sort it out for you...

    I found out that (for some fuckin reason) it is legal to sell a vehicle that you don't have the title to.


    Yea, I'm a bit worried about all that.
    I thought about returning it, but for that reason (the no $)...I haven't even tried.

    Not gonna help ya, but frankly that's why I never buy used, just too much hassle... I can usually haggle a new vehicle down where I want it, and get a manufacturers warranty to boot. That way if I have issues with that dealer, just go somewhere else...

    I know the depreciation argument, but I'll take the depreciation over the headache...

    Possession is nine tenths of the law. If push comes to shove part it out silently. Known people only. Then melt the aluminum down and sell to scrap dealer. If the repo co can't find it it doesn't exist.

    If a dealer can get away with this shitz and nobody can help or do anything I would buy a frame and title and that bike would no longer exist, just like the title.

    well...this is only the 2nd vehicle I've ever purchased.
    I figured, its a dealership...they've been in business for a number of years...how much trouble could one expect purchasing from a reputable (so I thought) licensed dealer?

    Never expected them to be this shady.

    Maybe I will just take my new parts off it and just eat the cost of the new tire and rear brakes, then tell them I want my money back and see what happens....get into an 07-09 VFR for a little more $$$
    O how I wish it were illegal here...I'd have someones head in a vice over this.:mad:

    :tongue: only problem is, can the parts really be worth more than the whole? or, how do I get a hold of a frame and title? just glancing, but it looks like any time you buy a frame they just issue a bill of sale...then I apply for a new title from utah? I'm thinkin there's a lot more trouble there.
    plus, there's a loan through my credit union on the bike...they (and insurance) have the vin...how does one go about sorting that? :redface:

    I'm in Utah. The Edge is the dealership.

    Is the place still open? If it were me, I would walk in and wheel out the most expensive bike in the place. When they try to stop you, demand they call the police.... demand to know what the diffrence is between stealing money from you (taking money and not leagally selling you the bike) and you stealing from him. Maybe get some media involved. Any local stations have a segment that exposes fraud? At very least, I would follow him home and let him know that you need to know where he lives in case the store goes under before this gets fixed. DO NOT THREATEN, that will land you in jail. Just be the biggest pain in his ass that he takes care of this so you will go away.... think about it, if you screw someone and they follow you home.... you bet your ass you would do whatever it takes to fix that situation. Once he files chapter 7 or 11, there is nothing you are going to be able to do to him leagally. 5 grand is nothing for a dealership, sounds like this guy is probably looking to write off hundreds of thousands, you will be last in line to get anything.... I wish you the best

    I'm actually thinking its time to hit up gephardt for getting some media light on this situation.

    edit: I just sent gephardt an email. Hopefully he can help :tongue:

    hmm...more good ideas.
    gotta love the internet!

    They are still open, but there aren't any bikes left in the building...some helmets, tires, oils...not much.

    How come you payed for a bike without the docs in your name?
    In the u/k we will not buy any vehicle without the registration docs for that vehicle with it and also with the guys address on it.
    So, you can see your bike, see the guy, his house,all docs line up, sign over when he`s there to your name ,then part with the cash!
    There`s a txt service here that when you enter the reg of the bike it will txt back it`s history ,eg; stolen,on credit,insurance right off ect.
    Just hang on to it whatever, if you got a reciept, it`s yours.
    Also if you buy from a dealer here ,all customers are protected from any unfortunate events that may arise after.
    Good luck! anyway just ride it,it`s for fun!!!
